This evening, reading our Media Blog, I ran across the following post in our comments:

"Ampersand Publishing Initiates Legal Action against The Santa Barbara Independent

"SANTA BARBARA, Calif.--(BUSINESS WIRE)--Ampersand Publishing, LLC, owner and operator of the Santa Barbara News-Press, filed a complaint in U.S. District Court against The Santa Barbara Independent. The filing charges The Independent with copyright infringement, misappropriation of trade secrets, unfair business competition, and intentional and negligent interference with prospective economic advantage and contract.

"According to the complaint, The Independent obtained two different confidential unpublished articles belonging to the News-Press and published one of them, in violation of the copyright laws. The Independent was not authorized to possess or publish either article. The News-Press has alleged that these articles constituted trade secrets that were misappropriated by The Independent.

"It is the intent of Ampersand Publishing to protect its confidential materials and trade secrets. Ampersand is seeking unspecified actual and punitive damages, injunctive relief and attorneys’ fees.

My first inclination was to consider this an online prank; I have subsequently verified that the Business Wire release is indeed a valid posting from News-Press flak Agnes Huff.

Our company has not been served a complaint on this matter -- yet. That the release comes before informing us of the intended suit speaks to me of both a strategic as well as legal intent. No surprise, considering with whom we are dealing. I would like to assure the powers that be at the News-Press, as well as the community, that it will take more than specious bullying tactics to silence us at the Independent.

Also, as we are recently steeled in occupying a place within a media flurry, interested parties may direct any questions to me at 805-965-5205 x132 on behalf of The Independent. The rest of our staff will be busy producing our online and weekly print editions. I will be tied up tomorrow, from 10am to 4pm, but will be available thereafter.

Should the News-Press wish to serve me papers, if that is the next step, I will be available in my office after a round of golf with my friends.

Discussion Guidelines

The "trade secret" argument is most amusing, because for an unpublished article to be a Trade Secret it must be something that the newspaper would consider an asset that got ripped off. So if that article were so valuable, why did not Newspress publish it on their own, especially because their own staff at the time wrote it?

Besides, all the details in that unpublished article about the events in the newsroom when Armstrong gave Roberts the perp walk were details told in way more detail in several other news articles in other publications through a few days later. None of the content was a secret, especially with all the more details in the sordid first-person account in the Brangingham opus article on why he left the perpetual Amateur Hour there at De La Guerra Plaza.

This is all about the text (a scanned page) of an unpublished draft Newspress article that appeared for a couple of days as a file link at the Indy web site. That page was spread all around and hardly was any secret. The Indy just put it at their web site.

Hell, I had the page in my hand and only regret I did not scan it and spread it all around the Internets myself, to be found readily through The Google. I got it from a far different source than the Indy, so if I had it, then it must have been all over this town almost to the point of being stapled to the power pole on my street by the lost dog notice.

Speaking of hyperlinking attributions, I wonder if an actual staff member will have a byline on this story in the N-P, or will the Good Dr.-By-Mail Huff get the byline? Cuz you know this story is a-comin', don'tcha?

The Newspress published an article Friday morning, clearly stating that the Indy already has been sued. But the Indy Publisher here writes that after dark he has yet to receive any lawsuit served.

Would the Newspress make a claim that was not true?

The article "Friday morning" I noted was an article at their web site slightly after midnight. Now, it is not in the print edition nor at the web site any longer.

That comment is the Newspress article (no author given) that appeared at their web site for about 10 minutes, then mysteriously disappeared later and never was in the print edition for Friday morning, today. Why would they hold their own article when the other "rival" news media ran the story, such as Santa Barbara Daily Sound?

I really hope whatever lawsuit results (if it's ever served) doesn't end up unnecessarily costing the Indy a lot of money in legal fees. We know Wendy can bankroll as many frivolous lawsuits as she wants, but I feel bad that the Indy might need to spend big bucks to defend themselves. Can someone comment?

Merriam-Webster Online defines "apologist" as "one who speaks or writes in defense of someone or something." The concept of apology usually carries with it an element, either real or feigned, of sorrow. Since Agnes Huff is a sorry excuse for a PR professional, "apologist" is probably the most appropriate term here, rather than "quisling," which, as was pointed out above, means traitor.

I am sick this is happening to the Independent and this community. Forget the lawyers for a moment, where are the shrinks (actual doctors)? Imagine all the madness that hasn't "leaked" out. I've also experienced several "disappearances" with various SBNP elitists when doing research. Creepy strange. I don't have anything to cancel. I do take note of the advertisers who remain with the self-destructive madness. What kind of business plan do they have? At this point they are complicit with these strange and soon to be caught in illegal tentacles. They've had opportunity to do something productive for community, they go with the madness. And the Chamber of Commerce? They were moved over street art. What about the people of this community? I can't believe Wendy has rendered all these businessmen/businesses this impotent.

I am corrected. The Newspress "article" on their lawsuit indeed has appeared in Business section and not the news A-section. Not so sure it is about "business" but they hardly have any original articles in the Biz section, which routinely are just full of all the best from Associated Press, New York Times, and McClatchy News service.

File that one with the series of articles about fresh basil and cooking tips that appeared on the top of the A-section a month or so ago.

When you consider the core issue - one newspaper suing another for collecting and reporting news -you have to truly be flabbergasted. This has to be a case study in every J-school in the US.

His name has become an eponym for traitor, especially a collaborationist.[1]

and the definition of collaborationist hits Dr. Huff squarely:

Collaborationism, as a pejorative term, can describe the treason of cooperating with enemy forces occupying one's country. As such it implies criminal deeds in the service of the occupying power, including complicity with the occupying power in murder, persecutions, pillage, and economic exploitation as well as participation in a puppet government.

Enemy forces occupying one's country indeed.
